Why if I’ve Been Charged with Two Different DUI Offenses?

In California, a non-injury DUI is charged under Vehicle Code section 23152. That section has multiple subdivisions.

  • The two most common subdivisions are:
  • Vehicle Code sections 23152(a)
  • Vehicle Code section 23152(b)

Most people who are arrested for DUI are charged with violating both of these subdivisions.

Vehicle Code section 23152(a) says that “it is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle.” California law says that someone is under the influence when, as a result of drinking alcohol, “his or her mental or physical abilities are so impaired that he or she is no longer able to drive a vehicle with the caution of a sober person, using ordinary care, under similar circumstances” (CALCRIM 2110; People v. Schoonover (1970) 5 Cal.App.3d 101, 105-107).

To prove this charge, district attorneys commonly use observations about a person’s driving, such as weaving or driving significantly above or below the speed limit, and the person’s performance of field sobriety tests, such as the walk and turn and the one leg stand. The arresting officer will also testify about any signs of alcohol use, such as red or watery eyes, slurred speech, or the odor of alcohol.

In defending against a charge of Vehicle Code section 23152(a), it is important to aggressively cross-examine the arresting officer about his or her observations of the person’s driving in order to undermine any suggestion of bad driving. Further, it is important to present the jury with any pre-existing medical conditions that would cause a person to appear impaired when he actually is not, and that might affect his ability to perform field sobriety tests.

The other common subdivision of the DUI law is Vehicle Code section 23152(b). That section says that “it is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” In order to be found guilty of violating this code section, the district attorney must prove beyond a reasonable doubt that the driver’s blood alcohol level was 0.08 or higher at the time he or she drove. There are a lot of factors that can affect an individual’s blood alcohol level, including age, sex, rate of consumption, drink strength, food, medications, and many more.

To prove this charge, district attorneys use the results of blood, breath, or urine samples taken from an individual after driving.
