Paraphernalia: The definition of paraphernalia is any equipment that may be used to inhale, inject, prepare, produce, or hide illegal drugs. It is prohibited by law for any individual to import, export, or sell any paraphernalia. Examples of this include items such as bongs, pipes, syringes, and more.
Possession: An individual in possession of illegal drugs may either face simple possession charges, or possession with intent to sell or distribute. This has to do with the quantity of drugs found.
Manufacturing or Delivery: A person can be arrested on drug manufacturing charges if he or she participates in any part of an illegal drug’s production process. Delivering any illegal drug is also prohibited.
Trafficking: Drug trafficking and distribution are of the more serious charges because they often involve transporting large quantities of illegal drugs. Even if you had a large quantity of drugs and did not intend to sell them, law enforcement may still charge you with distribution simply because of the amount that was found.
Dealing: Drug dealing charges are less severe than trafficking charges, as they are seen on two completely different scales. Drug dealing refers to one person selling a smaller amount of drugs, while trafficking means much larger amounts.

How Proposition 47 Can Impact Your Case – Simple Possession of Narcotics Reduced to Misdemeanor

California voters passed Proposition 47 on November 4, 2014. Proposition 47 made numerous changes to the California criminal law that have had a substantial effect upon a wide variety of cases. One of the primary areas where Proposition 47 has had a dramatic impact is in California’s drug laws.

Prior to Proposition 47, simple possession of most drugs other than marijuana was a wobbler, or, in other words, a crime that could be charged as either a misdemeanor or a felony in the discretion of the district attorney. With the passage of Proposition 47, crimes such as possession of methamphetamine (Health & Safety Code section 11377) and cocaine (Health & Safety Code section 11350) are now non-alternative misdemeanors for the vast majority of people. This means that instead of facing a maximum of three years in jail or formal probation, most people charged with simple possession now face at most one year in jail and informal probation.

While this is very helpful for those currently charged with drug possession offenses, or those who are charged in the future, Proposition 47 also provides relief for those who were previously convicted of such offenses.
